25 Eligibility of individuals
For this Act, an individual is an eligible person if—
the individual—
is an adult; and
has not been convicted, or found guilty, in the last 5 years, whether in the ACT or elsewhere, of an offence—
involving fraud or dishonesty; or
against a law about gaming; and
has not been convicted, or found guilty, in Australia in the last 5 years of an offence punishable by imprisonment for at least 1 year; and
has not been convicted, or found guilty, outside Australia in the last 5 years of an offence that, if it had been committed in the ACT, would have been punishable by imprisonment for at least 1 year; and
is not, or at any time in the last 5 years has not been, bankrupt or personally insolvent; and

at any time in the last 5 years was not involved in the management of a corporation when—
the corporation became the subject of a winding‑up order; or
a controller or administrator was appointed; and
has not contravened the totalisator rules or this Act; and
the commission believes on reasonable grounds that the individual—
has a reputation for sound business conduct; and
has a reputation for sound character; and
has a satisfactory financial position and financial background.
Despite subsection (1), the Minister or commission may decide that an individual is an eligible person if satisfied that—
the operation of the totalisator would not be adversely affected if the Minister or commission decided that the individual is an eligible person; and
it is otherwise in the public interest that the individual be treated as an eligible person.
