39 Canopy contribution agreements—exemption
(1)
An applicant under section 21 may apply to the decision-maker for an exemption from the requirement to enter into a canopy contribution agreement.
(2)
The decision-maker must, as soon as practicable after receiving an application under subsection (1), decide whether to exempt the applicant from the requirement to enter into a canopy contribution agreement.
(3)
In deciding whether to exempt the applicant, the decision-maker must consider—
(a)
whether the applicant is disadvantaged by any social or financial hardship; and
(b)
any matters prescribed by regulation.
