254 When is a provision a WHS civil penalty provision
A subsection of part 7 (Workplace entry by WHS entry permit‑holders) (or a section of part 7 that is not divided into subsections) is a WHS civil penalty provision if—
the words ‘WHS civil penalty provision’ and a maximum penalty, expressed as a WHS civil penalty provision tier, are set out at the foot of the subsection (or section); or
another provision of part 7 specifies that the subsection (or section) is a WHS civil penalty provision.
A subsection of a regulation (or a section of a regulation that is not divided into subsections) is a WHS civil penalty provision if—
the words ‘WHS civil penalty provision’ and a maximum penalty, expressed as a WHS civil penalty provision tier, are set out at the foot of the subsection (or section); or
another provision of a regulation specifies that the subsection (or section) is a WHS civil penalty provision.
