Workers Compensation Act 1951

This section applies to an individual (the timber contractor) who is engaged by a person (the principal) under a contract for services to do any of the following work:

logging (including, for example, felling, crosscutting, snigging, loading, carting, bundling and debarking);

felling or cutting trees for firewood;

delivering timber or firewood;

clearing timber, cutting scrub, preparing land for tree planting, planting trees, pruning trees or coppice cleaning.

The timber contractor is taken to be a worker employed by the principal if—

the work is for (or incidental to) the principal’s trade or business; and

the timber contractor personally does part or all of the work; and

if the principal is a corporation—the timber contractor is not an executive officer of the corporation.

This section applies whether the work is to be performed by the timber contractor—

for the principal; or

for someone (other than the principal) with whom the timber contractor has no contract to perform the work.
