163 Employment after 2nd offence
For this section, an employer has been convicted of an offence if the employer has been convicted of a 2nd or subsequent offence against any of the following sections:
section 147A (Compulsory insurance—offences)
section 155 (Information for licensed insurers on application for issue or renewal of policies)
section 156 (Information for licensed insurers after renewal of policies)
section 157 (Information for licensed insurers after end or cancellation of policies)
section 158 (Information for new licensed insurers after change of insurers)
section 203 (Criminal liability of executive officers).
Subsection (1) only applies to an offence against section 203 if the offence relates to the contravention by a corporation of another section mentioned in subsection (1).
An employer who has been convicted of an offence within the last 5 years must not employ a territory worker.
Maximum penalty: imprisonment for 5 years.
