52 Delegation by the Finance Minister

(1)

The Finance Minister may, by writing, delegate any or all of the Finance Minister’s functions or powers under sections 13, 23 and 26 to:

(a)

the Secretary of the Finance Department; or

(b)

an SES employee, or acting SES employee, in the Finance Department.

Note:

The expressions SES employee and acting SES employee are defined in section 2B of the Acts Interpretation Act 1901.

(2)

The Finance Minister may, by writing, delegate any or all of the Finance Minister’s powers under section 18 to:

(a)

the Secretary of the Finance Department; or

(b)

an SES employee, or acting SES employee, in the Finance Department; or

(c)

the Chair (within the meaning of section 5 of the Future Fund Act 2006); or

(d)

an SES employee, or acting SES employee, in the Agency.

Note:

The expressions SES employee and acting SES employee are defined in section 2B of the Acts Interpretation Act 1901.

(3)

In performing functions, or exercising powers, under a delegation under subsection (1) or (2), the delegate must comply with any directions of the Finance Minister.
