If a non‑participating party to a proceeding gives the Tribunal written notice (a participation notice) that the party wishes to participate in the proceeding, the Tribunal must decide whether or not the party is to participate in the proceeding.

An election notice relates to a kind of proceeding. A participation notice relates to a particular proceeding of that kind. The election notice continues to apply to other proceedings of that kind.
