Transfer of recovery rights to Commonwealth

In force

Immediately after the Secretary makes a refund declaration, any rights that the refund recipient had when the refund declaration was made to recover an amount equal to the refund amount from the registered provider or former registered provider specified in the refund declaration are, by force of this section, transferred to the Commonwealth.

Note:

Any rights that the refund recipient has to receive from the registered provider or former registered provider any additional amounts are not transferred to the Commonwealth by force of this section.
