Revocation on Commissioner’s own initiative
The Commissioner may, in writing, revoke the approval of an approved residential care home in relation to a registered provider if the Commissioner is satisfied that the home no longer meets the requirements in paragraph 113(b).
Revocation at the request of registered provider
The Commissioner may, in writing, revoke the approval of an approved residential care home in relation to a registered provider if the provider requests the Commissioner, in writing, to revoke the approval.
Continuity of care
In deciding whether to revoke the approval of an approved residential care home under subsection (1) or (2), the Commissioner must consider whether appropriate arrangements are in place to ensure continuity of care for individuals at the home.
A registered provider must comply with any requirements prescribed by the rules relating to continuity of funded aged care services for individuals: see section 149.
