172 Offence relating to failure to comply with responsibility to consider suitability matters relating to responsible persons
A registered provider of a kind prescribed by the rules must, in relation to a person who is one of the responsible persons of the registered provider:
at least once every 12 months:
consider the suitability matters in relation to the person in accordance with any requirements prescribed by the rules; and
be reasonably satisfied that the person is suitable to be involved in the delivery of funded aged care services; and
keep a record of those matters that complies with any requirements prescribed by the rules; and
comply with any other requirements prescribed by the rules.
An entity commits an offence if:
the entity is a registered provider; and
the entity fails to comply with subparagraph (1)(a)(i).
Penalty: 300 penalty units.
