553 Registered providers’ obligations in relation to disclosers
Ensuring aged care workers and responsible persons who make disclosures are not victimised
A registered provider must ensure, as far as reasonably practicable, compliance with section 549, subsection 550(1) and subsections 551(1) and (3) in relation to an individual who:
is an aged care worker or responsible person of the registered provider; and
makes a disclosure that qualifies for protection under section 547.
The obligation under subsection (1) covers not only compliance by the registered provider with those provisions but extends to the registered provider ensuring as far as reasonably practicable that there is also compliance by others, such as the provider’s other aged care workers, responsible persons and associated providers.
Protecting discloser identities
If an individual makes a disclosure that qualifies for protection under section 547 to a person (the recipient) who is:
an aged care worker of a registered provider; or
a responsible person of a registered provider;
the provider must take reasonable measures to ensure that the recipient does not disclose the fact that the individual was the maker of the disclosure, except as authorised by this Part.
