11 Delegation by APVMA

(1)

The APVMA may, by writing under its common seal, delegate to:

(b)

a committee; or

(c)

a member of the staff of the APVMA; or

(d)

an authority of the Commonwealth; or

(e)

a person appointed or engaged under the Public Service Act 1999;

all or any of the APVMA’s powers and functions.

(1A)

The APVMA may only delegate its powers under section 130 or section 131AA of the Code set out in the Schedule to the Agricultural and Veterinary Chemicals Code Act 1994 to a member of staff who is an SES, or acting SES, employee.

(2)

A delegate of the APVMA is, in the exercise of the delegate’s delegated powers and functions, subject to the APVMA’s directions.
