34MA Extension of limitation periods
The regulations may make provision for and in relation to either or both of the following:
extending the limitation period for information covered by an item of the table in subsection 34M(1);
ending such an extension.
An application for an extension is not required.
One of the circumstances in which there may be an extension of a limitation period under the regulations is if, at least 3 years before that limitation period (including that period as previously extended) will end, an application that satisfies the following is lodged:
the application is under a provision of this Part prescribed by the regulations for the purposes of this paragraph;
the application satisfies the requirements prescribed by the regulations for the purposes of this paragraph.
Maximum extension
The total length of all extensions of a limitation period, for particular information covered by an item of the table in subsection 34M(1), must not be more than 5 years.
Powers may be conferred on the APVMA
In relation to an extension of a limitation period, or ending such an extension, the regulations may confer a power to make a decision of an administrative character on the APVMA.
