233 Authorised officers

(1)

The Minister may make a written determination that a specified person is an authorised officer for the purposes of this Part. The determination has effect accordingly.

Note:

A person may be specified by name, by inclusion in a specified class or in any other way.

(2)

The Minister may make a written determination that a specified authorised officer does not have such of the powers conferred on an authorised officer by this Part as are specified in the determination. The determination has effect accordingly.

(3)

The Minister may make a written determination that the powers conferred on a specified authorised officer by this Part are subject to such limitations as are specified in the determination. The determination has effect accordingly.

(4)

If the Minister makes a determination under subsection (2) or (3) about a named individual, the Minister must give the individual a copy of the determination.

(5)

The Minister may issue a written certificate stating any or all of the following:

(a)

that a specified person was at a specified time, or was at all times during a specified period, an authorised officer for the purposes of this Part;

(b)

that at a specified time, or at all times during a specified period, a specified person had such of the powers conferred on an authorised officer by this Part as are specified in the certificate;

(c)

that a specified time, or at all times during a specified period, the powers conferred on a specified person by this Part were subject to such limitations as are specified in the certificate.

Note:

A person may be specified by name, by inclusion in a specified class or in any other way.

(6)

In any proceedings relating to this Act, a certificate under subsection (5) is prima facie evidence of the matters in the certificate.

(7)

A document purporting to be a certificate under subsection (5) must, unless the contrary is established, be taken to be a certificate and to have been properly given.
