51 Onus
In proceedings before the Tribunal in pursuance of an application under section 43:
(a)
the Archives has the onus of establishing that a decision given by the Archives was justified or that the Tribunal should give a decision adverse to the applicant; and
(b)
the Tribunal is not restricted by any determination made at any time under section 35.
