Payment of benefit to person other than beneficiary, for beneficiary’s welfare
42 Payment of benefit to person other than beneficiary, for beneficiary’s welfare
This section applies if CSC considers it appropriate that some or all of a benefit that would (apart from this section) be payable to or for a person (the beneficiary) be paid instead to another person for the beneficiary’s welfare (for example because the beneficiary is a child, is imprisoned or is under a disability).
CSC may determine that all, or a specified part, of the benefit:
is payable to a specified person other than the beneficiary for the beneficiary’s welfare; and
is not payable to the beneficiary.
The determination has effect according to its terms, despite any other provision of this Act.
