47 Declaration of international instruments
The Minister may, after consulting the appropriate Minister of each State, by legislative instrument, declare an international instrument, being:
an instrument ratified or acceded to by Australia; or
a declaration that has been adopted by Australia;
to be an international instrument relating to human rights and freedoms for the purposes of this Act.
The declaration must include:
a copy of the international instrument; and
a copy of whichever of the following is applicable:
Australia’s instrument of ratification of, or accession to, the international instrument;
the terms of any explanation given by Australia of its vote in respect of the international instrument.
Part 4 of Chapter 3 (sunsetting) of the Legislation Act 2003 does not apply to the declaration.
