52 Seizing other evidential material

(1)

This section applies if an inspector enters an investigation area under an investigation warrant to search for evidential material.

(2)

The investigation powers include seizing a thing that is not evidential material of the kind specified in the warrant if:

(a)

in the course of searching for the kind of evidential material specified in the warrant, the inspector finds the thing; and

(b)

the inspector reasonably believes that:

(i)

the thing is evidential material of another kind; and

(ii)

it is necessary to seize the thing in order to prevent its concealment, loss or destruction.
