82 Power to make requirement of a person

(1)

An inspector may, in connection with exercising a power under Division 2 or 3 in relation to a monitoring area or an investigation area, make a requirement of a person in the area.

Note:

See section 83 for offences relating to a contravention of a requirement under this subsection.

(2)

Without limiting subsection (1), an inspector may require:

(a)

a person in the monitoring area or investigation area to show, or demonstrate the operation of, any equipment or machinery in the monitoring area or investigation area; or

(b)

a relevant person in relation to the monitoring area or investigation area to provide the inspector, or a person assisting the inspector, with all reasonable facilities and assistance for the effective exercise of the inspector’s powers or the powers of the person assisting.

(3)

This section does not apply to the following:

(a)

a requirement to facilitate entry to an Australian submarine (which is dealt with by section 81);

(b)

a requirement to answer a question or produce a document (which is dealt with by section 84).
