83E Conclusive certificates

(1)

The Minister may, in exceptional circumstances, issue a conclusive certificate in relation to a security clearance decision, or security clearance suitability assessment, that is an externally reviewable decision if the Minister believes that:

(a)

it would be prejudicial to security to change the decision or assessment; or

(b)

it would be prejudicial to security for the decision or assessment to be reviewed.

(2)

The Administrative Review Tribunal must not review, or continue to review, a security clearance decision or security clearance suitability assessment in relation to which the Minister has issued a conclusive certificate under subsection (1).
