252A Direction to operator of first point of entry to carry out activities to control vectors
The Director of Human Biosecurity or a chief human biosecurity officer for a State or Territory may, in writing, direct the operator of a first point of entry to carry out specified activities within the area of a first point of entry to control a vector if the Director or chief has reasonable grounds to believe that carrying out those activities in that area is necessary to ensure that the vector has not spread into, or is not likely to become established in, the area.
A chief human biosecurity officer for a State or Territory may give a direction under subsection (1) to an operator of a first point of entry only if the first point of entry is in the State or Territory.
Offence and civil penalty
A person commits an offence if:
the person is given a direction under this section; and
the person fails to comply with the direction.
Penalty: Imprisonment for 5 years or 1,000 penalty units, or both.
A person who is given a direction must comply with the direction.
Civil penalty: 300 penalty units.
