295 Appropriate ballast water records for vessels
(1)
A vessel has appropriate ballast water records if:
(a)
the vessel has on board records, made in accordance with section 293, that are sufficient to allow any biosecurity risk associated with the vessel’s ballast water or sediment to be identified and assessed; and
(b)
the vessel does not have on board any records, made using the vessel’s ballast water record system, that are false or misleading in a material particular.
(2)
For the purposes of subsection (1), if a vessel (the first vessel) is being towed by another vessel and has no crew on board, a record that is on board the other vessel is taken to be on board the first vessel.
