Biosecurity Act 2015

The Director of Biosecurity may apply the proceeds of the sale of a thing under section 610 against:

if the thing was subject to one or more charges under section 598 or 604 because one or more cost‑recovery charges had not been paid—each of those charges; and

any other cost‑recovery charge that is due and payable to the Commonwealth under this Act by the owner of the thing.

The Director of Biosecurity must pay the remainder of the proceeds, if any, to the owner of the thing.

However, any remainder is forfeited to the Commonwealth at the end of 30 days after the sale if the Director of Biosecurity:

has not been able to locate the owner of the thing, despite making reasonable efforts; and

has certified to that effect in writing.

Nothing in this section affects the right of the Commonwealth to recover fees or expenses by other means.
