Cy pres and similar schemes

In force

In determining the purposes of a trust, have regard to:

(a)

any scheme for the application of property cy pres that relates to the trust; or

(b)

any similar scheme that relates to the trust;

whether under equity or any other law of a State or Territory that relates to charitable trusts.

Note:

Trust law may, in certain circumstances, allow the purposes of a trust to be altered to remove purposes that are not charitable purposes.
