Agents may act on behalf of groups of performers

In force

(1)

This section applies in respect of all members of a group of performers who have an interest in the copyright in a sound recording of a live performance.

(2)

All members of the group are taken to have granted a licence or permission (however described) to a person:

(a)

to do an act comprised in the copyright; or

(b)

to do any other act in relation to the copyright;

if an agent of the group, acting within the scope of his or her actual or apparent authority, has granted a licence or permission to the person to do the act.

Note:

The person may still need to obtain the licence or permission of other owners of the copyright before doing the act.
