The amount of the equitable remuneration that, by a remuneration notice given to a collecting society under section 113Q, the body administering an educational institution undertakes to pay for licensed copying or communicating is the amount:

agreed between the society and the body; or

determined by the Copyright Tribunal under subsection (2).

The Copyright Tribunal may determine the amount of the equitable remuneration if:

the society and the body fail to determine the amount by agreement under paragraph (1)(a); and

the society or the body apply to the Tribunal to have the Tribunal determine the amount.

Section 153A sets out the procedure of the Copyright Tribunal in dealing with the application.

A determination of the Tribunal under subsection (2) may be expressed to have effect in relation to copying or communicating done before the day on which the determination is made.
