Scope
This section applies if:
a constable enters premises under section 3ZZKA; and
the entry is authorised by a monitoring warrant.
Powers
The constable has the following powers in relation to the premises:
the power to seize things found during the exercise of monitoring powers on the premises that the constable suspects on reasonable grounds to be:
evidential material; or
evidential material (within the meaning of the Proceeds of Crime Act 2002); or
tainted property (within the meaning of that Act); or
seizable items;
the power to conduct an ordinary search or a frisk search of a person at or near the premises if the constable suspects on reasonable grounds that the person has any evidential material or seizable items in his or her possession;
the power to seize other things found while conducting an ordinary search or a frisk search of a person at or near the premises that the constable suspects on reasonable grounds to be:
evidential material; or
evidential material (within the meaning of the Proceeds of Crime Act 2003); or
tainted property (within the meaning of that Act); or
seizable items.
