268.9 Crime against humanity—extermination
A person (the perpetrator) commits an offence if:
the perpetrator causes the death of one or more persons; and
the perpetrator’s conduct constitutes, or takes place as part of, a mass killing of members of a civilian population; and
the perpetrator’s conduct is committed intentionally or knowingly as part of a widespread or systematic attack directed against a civilian population.
Penalty: Imprisonment for life.
In subsection (1):
causes the death of includes causes death by intentionally inflicting conditions of life (such as the deprivation of access to food or medicine) intended to bring about the destruction of part of a population.
