Data Availability and Transparency Act 2022

The National Data Advisory Council is established by this section, and has the function of advising the Commissioner on the following matters relating to use of public sector data and provision of access to it in a controlled manner:

ethics;

balancing data availability with privacy protection;

trust and transparency;

technical best practice;

industry and international developments;

any other matters.

The Council may perform the Council’s functions only with respect to the following:

sharing of data under, or purportedly under, section 13 and the use of data in relation to such sharing;

matters incidental to the execution of any of the legislative powers of the Parliament or the executive power of the Commonwealth.
