Designs Act 2003

This section applies if the Registrar is satisfied, in the course of examining a registered design, that a ground for revocation of the registration of the design has been made out.

The Registrar must notify the registered owner of the design to that effect.

The registered owner of the design may request that the Registrar amend the Register in such a way that the ground for revocation is removed.

A request under subsection (3) must be made in the manner prescribed by the regulations.

The Registrar must consider and deal with the request in the manner prescribed by the regulations.

An amendment must not be such as to:

increase the scope of the design registration; or

alter the scope of the registration by the inclusion of matter that was not in substance disclosed in the original design application, representations or other documents.
