31 Disability standards

(1)

The Minister may, by legislative instrument, formulate standards, to be known as disability standards, in relation to any area in which it is unlawful under this Part for a person to discriminate against another person on the ground of a disability of the other person.

(2)

Without limiting subsection (1), a disability standard may:

deal with the following:

(i)

reasonable adjustments;

(ii)

strategies and programs to prevent harassment or victimisation of persons with a disability;

(iii)

unjustifiable hardship;

(iv)

exemptions from the disability standard, including the power (if any) of the Commission to grant such exemptions; or

(b)

provide that the disability standard, in whole or in part, is or is not intended to affect the operation of a law of a State or Territory.

(3)

Before making a disability standard, the Minister must take into consideration any comments made to the Minister by a Minister of a State or Territory who is responsible for matters relating to disability discrimination.
