53 Combat duties and peacekeeping services
This Part does not render it unlawful for a person to discriminate against another person on the ground of the other person’s disability in connection with employment, engagement or appointment in the Defence Force:
in a position involving the performance of combat duties, combat‑related duties or peacekeeping service; or
in prescribed circumstances in relation to combat duties, combat‑related duties or peacekeeping service; or
in a position involving the performance of duties as a chaplain or a medical support person in support of forces engaged or likely to be engaged in combat duties, combat‑related duties or peacekeeping service.
In this section:
combat duties means such duties as are declared by the regulations to be combat duties for the purposes of this section.
combat‑related duties means such duties as are declared by the regulations to be combat‑related duties for the purposes of this section.
medical support person means:
a person exclusively engaged in the search for, or the collection, transport or treatment of, the wounded or sick, or in the prevention of disease; or
a person exclusively engaged in the administration of medical units and establishments.
peacekeeping service has the same meaning as in the Military Rehabilitation and Compensation Act 2004.
