Variation of Minister’s ruling
The Minister may, by written instrument, vary a ruling made by the Minister, if the Minister is satisfied that it is appropriate to do so.
If the Minister varies a ruling, the Minister must publish the variation on the Department’s website as soon as practicable.
Variation of CEO’s ruling
The CEO may, by written instrument, vary a ruling made by the CEO, if the CEO is satisfied that it is appropriate to do so.
If the CEO varies a ruling, the CEO must publish the variation on the NEPA’s website as soon as practicable.
When variation takes effect
A variation takes effect on the day specified in the variation (which must not be before the day it is published under subsection (2) or (4), as applicable).
Variation is not a legislative instrument
A variation made under subsection (1) or (3) is not a legislative instrument.
