307 Offence—failure to return identity card
A person contravenes this subsection if:
the person has been issued with an identity card under subsection 306(1); and
the person ceases to be a person referred to in paragraph 306(1)(a), (b) or (c); and
the person does not, within 14 days after so ceasing, return the person’s identity card to the Secretary.
Subsection (1) of this section does not apply:
to an authorised officer whose authorisation has been suspended; or
if the identity card was lost or destroyed.
A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the Criminal Code).
Strict liability offence
A person commits an offence of strict liability if the person contravenes subsection (1).
Penalty: 1 penalty unit.
