4 Fair work instruments etc. made before commencement
(1)
This clause applies in relation to:
(a)
a fair work instrument made before commencement; or
(b)
a transitional instrument as continued in existence by Schedule 3 to the Transitional Act.
(2)
A reference in the instrument to an employee or an employer does not include a deemed employee or a deemed employer, unless the instrument is, after commencement, varied to make it clear that the reference is intended to include a deemed employee or deemed employer.
(3)
This clause is not to be taken to confer a power to vary the instrument.
