The administrator of a scheme determined under subsection 323B(1) must give the Minister a report (the scheme operation report) about the operation of the scheme:

no later than 6 months after the Construction and General Division and its branches are placed under administration by force of subsection 323A(1); and

at the end of every subsequent 6 month period until the administration ends.

The scheme operation report must include:

a statement outlining the administrator’s activities under this Part during the preceding 6 month period; and

a statement listing any transactions that occurred during the preceding 6 month period involving the Construction and General Division, or any of its branches, if the administrator is of the opinion that the transactions may be unlawful; and

a copy of any financial records of the Construction and General Division, or any of its branches, that the administrator considers appropriate to include in the report.

The administrator must also give the Minister a copy of a report (the financial report) prepared in accordance with subsection (2B) that is relevant to:

the Construction and General Division and its branches; and

the 6 month period covered by the scheme operation report.

The financial report must:

be prepared, in accordance with the Australian Accounting Standards, from the financial records kept under subsection 252(1); and

contain the information set out in subsection 253(2) in relation to the Construction and General Division and its branches; and

give a true and fair view of the financial position and performance of the Construction and General Division and its branches.

If the administration for a branch of the Construction and General Division ends during the 6 month period covered by the scheme operation report, the financial report does not need to include information in relation to that branch.

The administrator must give the Minister the financial report no later than 3 months after giving the scheme operation report.

The Minister must table a copy of each report in each House of the Parliament within 15 sitting days of that House after the Minister receives it.
