343A Delegation by General Manager
The General Manager may, in writing, delegate to a member of the staff of the FWC all or any of the General Manager’s functions or powers under this Act.
Despite subsection (1), the General Manager’s functions or powers under the following provisions cannot be delegated:
subsection 13(2);
any provision of Chapter 2, 3 or 5 (other than subsection 159(1) or (2) or section 161);
subsection 183(4);
any provision of Part 3 or 4 of Chapter 7 (other than section 202);
any provision of Division 1, 2 or 3, or Subdivision B of Division 4, of Part 3 of Chapter 8;
subsection 278(2);
section 310;
section 323C or 323M;
subsection 329G(2);
section 334;
section 335;
section 335K;
subsection 336(1), (2), (3) or (5);
subsection 337K(4).
Despite subsection (1), the General Manager’s functions or powers under the following provisions can only be delegated to a member of the staff of the FWC who is an SES employee or an acting SES employee, or who is in a class of employees prescribed by the regulations:
subsection 159(1) or (2);
section 161;
section 180;
Subdivision A of Division 4 of Part 3 of Chapter 8;
subsection 293L(1);
any provision of Chapter 11 (other than a provision of Part 4 of that Chapter or subsection 337K(4)).
The expressions SES employee and acting SES employee are defined in section 2B of the Acts Interpretation Act 1901.
Despite subsection (1), the General Manager’s functions or powers under section 330, 331, 332 or 333 can only be delegated to:
a member of the staff of the FWC; or
any other person or body the General Manager is satisfied has substantial or significant experience or knowledge in at least one of the following fields:
accounting;
auditing;
financial reporting;
conducting compliance audits or investigations;
a field prescribed by the regulations for the purposes of this subparagraph.
Despite subsection (1), functions and powers under Division 3 of Part 4 (questioning on oath or affirmation) can only be delegated to a member of the staff of the FWC who is an SES employee or an acting SES employee.
In exercising powers or functions under a delegation, the delegate must comply with any directions of the General Manager.
