80 Division applies despite laws and agreements prohibiting transfer etc
This Division applies, and must be given effect to, despite anything in:
the Fair Work Act or any other Commonwealth, State or Territory law; or
any contract, deed, undertaking, agreement or other instrument.
Nothing done by this Division, and nothing done by a person because of, or for a purpose connected with or arising out of, this Division:
is to be regarded as:
placing an organisation or other person in breach of contract or confidence; or
otherwise making an organisation or other person guilty of a civil wrong; or
is to be regarded as placing an organisation or other person in breach of:
any Commonwealth, State or Territory law; or
any contractual provision prohibiting, restricting or regulating the assignment or transfer of any asset or liability or the disclosure of any information; or
is taken to release any surety, wholly or in part, from all or any of the surety’s obligations.
Without limiting subsection (1), where, but for this section, the consent of a person would be necessary in order to give effect to this Division in a particular respect, the consent is taken to have been given.
