Fair Work (Transitional Provisions and Consequential Amendments) Act 2009

The General Manager may, in writing, delegate to a member of the staff of FWA all or any of the General Manager’s functions or powers under this Act.

Despite subsection (1), the General Manager’s functions or powers under the following provisions cannot be delegated:

subsection 13(2);

any provision of Chapter 2, 3 or 5 (other than subsection 159(1) or (2) or section 161);

subsection 183(4);

section 197;

any provision of Part 3 or 4 of Chapter 7 (other than section 202);

any provision of Division 1, 2, 3 or 4 of Part 3 of Chapter 8;

subsection 278(2);

section 310;

section 334;

subsection 336(2);

subsection 337K(4).

Despite subsection (1), the General Manager’s functions or powers under the following provisions can only be delegated to a member of the staff of FWA who is an SES employee or an acting SES employee, or who is in a class of employees prescribed by the regulations:

subsection 159(1) or (2);

section 161;

section 180;

any provision of Part 2 of Chapter 7 (other than subsection 183(4) or section 197);

any provision of Part 2 of Chapter 8;

any provision of Division 5 or 6 of Part 3 of Chapter 8;

section 272;

any provision of Chapter 11 (other than section 334 or subsection 336(2) or 337K(4)).

The expressions SES employee and acting SES employee are defined in section 17AA of the Acts Interpretation Act 1901.

In exercising powers or functions under a delegation, the delegate must comply with any directions of the General Manager.
