10L Definition of arbitration

(1)

Arbitration is a process (other than the judicial process) in which parties to a dispute present arguments and evidence to an arbitrator, who makes a determination to resolve the dispute.

(2)

Arbitration of any of the following is family law arbitration, whether ordered by a court under subsection 13E(1) or not:

(a)

proceedings that are referable to arbitration within the meaning of subsection 13E(1A);

(b)

any part of such proceedings;

(c)

any matter arising in such proceedings;

(d)

a dispute about a matter with respect to which such proceedings could be instituted.
