70NBB Make‑up time parenting orders

(1)

If a child does not spend time with a person as required by a child‑related order as a result of the alleged contravention mentioned in subsection 70NBA(1), then, in lieu of that time, the court may make a parenting order (a make‑up time parenting order) that the child spend time with the person.

Note 1:

Parenting orders are made under Division 6.

Note 2:

The court may also make an order requiring the respondent to compensate another person for reasonable expenses incurred as a result of a child not spending time with that other person: see paragraph 70NBF(1)(c).

The court may make a make‑up time parenting order at any stage of the proceedings.

(3)

To avoid doubt, the amount of time specified in the make‑up time parenting order may be different from the amount of time that the child missed with the person as a result of the alleged contravention.
