70NCA Matters relating to bonds
This section sets out requirements relating to bonds that the court may require the respondent to enter into under paragraph 70NBF(1)(a).
Matters dealt with in bonds
A bond is to be for a specified period of up to 2 years.
A bond may be:
with or without surety; and
with or without security.
The conditions that may be imposed on the respondent by a bond include (without limitation) conditions that require the respondent:
to attend a post‑separation parenting program; or
to attend an appointment (or a series of appointments) with a family consultant; or
to attend family counselling; or
to attend family dispute resolution; or
to be of good behaviour.
Duty to explain bond
Before requiring the respondent to enter into a bond, the court must explain to the respondent, in language likely to be readily understood by the respondent:
the purpose and effect of the proposed requirement; and
the consequences that may follow if the respondent:
fails to enter into the bond; or
having entered into the bond—fails to act in accordance with the bond.
