10.67 Payment of costs

(1)

On receipt of a notice under rule 10.66(3) in relation to the costs of service, the applicant or the applicant’s lawyer, as the case may be, must pay to the Chief Executive Officer the amount specified in the notice as the amount of the costs.

(2)

If the applicant or the applicant’s lawyer fails to pay that amount within 28 days after receiving the notice:

(a)

except by leave of the Court, the applicant may not take any further step in the proceeding to which the local judicial document relates until the costs are paid to the Chief Executive Officer; and

(b)

the Chief Executive Officer may take such steps as are appropriate to enforce the undertaking for payment of the costs.
