Dealing with money paid into Court
2.42 Dealing with money paid into Court
Money paid into Court in a proceeding must:
if the Court has made an order under subrule (2)—be paid, credited or applied in accordance with the order; or
if paragraph (a) does not apply—be paid into the Litigants’ Fund.
A party may apply to the Court for an order:
that money paid, or to be paid, into Court be paid, credited or applied in a manner other than by payment into the Litigants’ Fund; and
in relation to the disbursement of any interest earned on the money.
As soon as practicable after money has been paid into Court in a proceeding, the relevant District Registrar will give a notice to each party stating that the money has been received and giving details of how the money has been paid, credited or applied.
