35.31 Withdrawing an application
(1)
A party who has filed an application under rule 35.12 or 35.14 may withdraw the application, in accordance with Form 120.
(2)
A notice filed under subrule (1) has the effect of an order of the Court dismissing the application.
(3)
A notice filed under subrule (1) does not affect any other party who has filed an application under rule 35.12 or 35.14 in relation to the same judgment as that mentioned in the withdrawn application.
(4)
A party who has filed a notice under subrule (1) must pay the costs of each other party to the application.
