41 Limit on disclosure to courts and tribunals
Except when it is necessary to do so for the purposes of this Act, a person who is, or has been, an entrusted person is not to be required to disclose, or produce a document containing, protected information to:
a court; or
a tribunal, authority or person that has the power to require the answering of questions or the production of documents.
However, subsection (1) does not prevent a person who is, or has been, an officer (within the meaning of section 56 of the Australian Prudential Regulation Authority Act 1998) from being required to disclose protected information (within the meaning of that section), or to produce a protected document (within the meaning of that section), when it is necessary to do so for the purposes of a prudential regulation framework law (within the meaning of subsection 3(1) of that Act).
