48 Delegation by Minister
(1)
The Minister may, in writing, delegate to:
(a)
the Secretary; or
(b)
an SES employee or an acting SES employee in the Department, other than a staff member;
the Minister’s functions or powers under the following provisions:
(c)
subsection 26(2) (appointment of acting Chair);
(d)
section 28 (leave).
Note:
Sections 34AA to 34A of the Acts Interpretation Act 1901 contain provisions relating to delegations.
(3)
In performing a function, or exercising a power, delegated under subsection (1), the delegate must comply with any written directions of the Minister.
