113 Recovery of levy and other amounts
The following amounts may be recovered by the Commonwealth as debts due to the Commonwealth:
levy that is due and payable;
an amount payable under section 112.
If:
levy is due and payable in respect of a statutory fishing right in respect of a period; and
that statutory fishing right is surrendered before any fishing activities are undertaken under the statutory fishing right during that period;
AFMA may, on behalf of the Commonwealth, by written notice given to the holder of the statutory fishing right, waive:
the levy payable in respect of that statutory fishing right in respect of the period; and
if any amount is payable under section 112 in respect of that levy—the amount so payable.
If:
levy is due and payable in respect of a fishing permit granted under section 32; and
that permit is surrendered before any fishing activities are undertaken under the permit;
AFMA may, on behalf of the Commonwealth, by written notice given to the holder of the permit, waive:
the levy payable in respect of that permit; and
if any amount is payable under section 112 in respect of that levy—the amount so payable.
