142 Documents and samples become Commonwealth property

(1)

All documents and samples given to the Authority for any purpose of this Act or produced to assist the Authority in the consideration of an application or proposal, or in the assessment or review of a resulting food regulatory measure, become, upon being so given or produced, the property of the Commonwealth and may, subject to section 114, be dealt with or disposed of in any manner that the Authority considers appropriate.

(2)

If the Authority publishes, or permits the public inspection of, any document that has become the property of the Commonwealth under subsection (1), no action or proceeding for defamation lies against the Commonwealth, a member of the Board, or a person assisting the Authority, in relation to the publication or public inspection of the document.
