96 Preparation of draft standard or variation

(1)

After considering an urgent application, the Authority must:

(a)

prepare in writing a draft standard or a draft variation of a standard; or

(b)

reject the application.

(2)

After considering an urgent proposal, the Authority must:

(a)

prepare in writing a draft standard or a draft variation of a standard; or

(b)

abandon the proposal.

(3)

If, under this section, the Authority prepares a draft standard, or a draft variation of a standard, the Authority must give public notice of the matters mentioned in subsection (4).

(4)

The notice must:

(a)

state that the Authority has prepared a draft standard, or a draft variation of a standard, as the case requires; and

(b)

include a copy of the draft standard or draft variation; and

(c)

call for written submissions from interested persons and appropriate government agencies, for the purposes of the Authority’s consideration of the draft standard, or draft variation, to be given to the Authority within the period specified in the notice (the submission period).

(5)

The submission period must not end later than 10 business days after the publication of the notice.

(6)

As soon as practicable after complying with subsection (3), the Authority must publish, on the Authority’s website, a copy of the notice mentioned in subsection (3), together with information about where a copy of the draft may be obtained.
